Applicable Law

These terms and conditions are governed by Swedish law, with the addition of any mandatory consumer protection laws in your country of residence. As a consumer, you are always entitled to the protection provided by the mandatory provisions of the law in your country of residence.

The information provided here represents the minimum rights you have as a consumer. Additional rights may apply according to the laws of your country of residence.

Orders and Order Confirmation

When you complete your order, you will automatically receive an order confirmation to your email address. The confirmation contains information about:

  • Ordered products
  • Price and any additional charges
  • Billing and delivery address

Always check the order confirmation. In case of any errors, contact us immediately via email.

Delivery

Delivery times typically vary by region:

  • Nordic Countries: 2-5 business days
  • Central Europe: 3-7 business days
  • Other EU & EEA: 5-10 business days

Orders placed during weekends will be shipped the following business day.

Shipping Partners

We primarily partner with Postnord as our carrier. For certain items shipped directly from warehouses or suppliers, we may use other carriers such as UPS, FedEx, DHL or Schenker.

Shipping Costs

Shipping costs are calculated based on:

  • Destination country (grouped into shipping zones)
  • Total weight of the order
  • Selected delivery method

The exact shipping cost will be calculated and displayed at checkout before payment is completed.

Customs and Import Duties

For deliveries to countries outside the EU (Norway and Switzerland), additional customs duties, taxes, and fees may apply. These additional charges are your responsibility and are not included in our prices or shipping costs. Please check with your local customs office for more information.

If delivery is delayed more than 10 days without notification from us, contact our customer service.

Prices and Payment

All prices include VAT at the applicable rate for your country. Transactions are processed in the following currencies based on your location:

  • Sweden: Swedish Krona (SEK)
  • Norway: Norwegian Krone (NOK)
  • Finland: Euro (EUR)
  • Denmark: Danish Krone (DKK)
  • Other European countries: Euro (EUR)

We reserve the right for:

  • Price changes from supplier
  • Potential printing errors in the price list
  • Price errors due to technical issues

Payment Methods

We accept the following payment methods:

  • Credit/Debit cards (Visa, Mastercard)
  • Direct bank transfer
  • Local payment options where available, such as invoice, direct payment etc

Available payment methods may vary by country.

Right of Withdrawal and Returns

You have a 30-day right of withdrawal from receipt of the goods. This applies to unused products in unopened original packaging. Package your item well, note that you as the sender are responsible for the package until it reaches us.

According to EU consumer law, the minimum withdrawal period is 14 days. We offer an extended 30-day period for your convenience. In some countries, local consumer law may provide additional rights.

Return Information

  1. Fill in a return form with:
    • What is being returned
    • Quantity
    • Order number
  2. Package the item well, preferably in original packaging
  3. Arrange your own return shipping method

Return Costs

The customer is responsible for the cost of return shipping. Please contact us at info@spagat.eu before making any returns. You need to arrange your own return shipping method.

Exceptions to Right of Withdrawal

Right of withdrawal does not apply to:

  • Hygiene articles where seal is broken (potties, toilet seats, CPAP products etc.)
  • Custom-ordered or custom-fitted products (e.g., cut canes, custom wheelchairs)

Warranty and Claims

All products are covered by warranty according to applicable consumer legislation in your country. The basic warranty period is at least:

  • Sweden: 3 years consumer protection period
  • Norway: 5 years for products with expected longer lifespan, otherwise 2 years
  • EU countries: Minimum 2 years statutory warranty

Making a Warranty Claim

  1. Contact us immediately via email at info@spagat.eu
  2. Describe the fault and preferably include photos
  3. Await our approval before returning

We follow the National Board for Consumer Disputes guidelines. For approved claims, we cover return shipping.

Warranty claims must be made within a reasonable time after you discovered the defect, but no later than two months from discovery of the defect, unless your country’s consumer laws specify a longer period.

Transport and Damage

We are responsible for the item during transport to you. For returns, you are responsible for the item until it reaches us.

In Case of Transport Damage

  • Report visible damage directly to the driver/agent
  • Contact our customer service within 1-3 days of receipt
  • Always keep original packaging for correct handling of the claim

Uncollected Packages

We reserve the right to charge for costs incurred for uncollected packages. Therefore, we charge the actual cost of return shipping and handling for any package that is not collected. The shipment remains at the postal agent for a period that may vary by country, but is typically around 7 days, before being returned to us.

When shopping with us, you consent to our handling of your personal data according to GDPR.

Dispute Resolution

In case of a dispute, we primarily strive for an amicable solution. If we cannot reach an agreement, the following options are available:

For customers in Sweden:

You can contact the National Board for Consumer Disputes (ARN) at www.arn.se.

For customers in the EU:

You can use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

For customers in Norway:

You can contact Forbrukerrådet at www.forbrukerradet.no.

These dispute resolution options do not affect your right to take the matter to court in your country of residence.

Limitation of Liability

We take no responsibility for indirect damages that may arise due to the product.

Force Majeure

We take no responsibility for delays or errors due to circumstances beyond the company’s control (Force Majeure), such as:

  • Labor disputes
  • Fire
  • War
  • Government decisions
  • Reduced or suspended delivery from supplier

We also take no responsibility for any changes to products or product properties changed by respective suppliers and other factors beyond our control.

Product Information

We reserve the right for:

  • Any printing errors on this website
  • Products being sold out
  • Color variations in product images – we do not guarantee that the images reflect the products’ exact appearance as color differences may occur depending on screen, photo quality and resolution
